These Terms of Service ("Terms") govern your use of the Join in mobile application and any associated website (together, the "Service"), operated by Join in ("Join in", "we", "us").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use Join in. By creating an account, you confirm that you meet this age requirement. We reserve the right to request proof of age at any time.
2. Your Account
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate information when creating your account, including your identity and location.
- You may not create accounts for others, maintain more than one account, or transfer your account.
Notify us immediately at hello@joinin.club if you suspect unauthorized access to your account.
3. Acceptable Use
You agree not to:
- Harass, threaten, or intimidate other users, on or off a session
- Upload offensive, illegal, or inappropriate content, including profile pictures
- Impersonate other people or create fake or misleading profiles
- Use the Service for commercial purposes without our written consent
- Attempt to reverse-engineer, scrape, or interfere with the Service
- Misrepresent your location or attendance at a session
- Create sessions for activities that are illegal or that knowingly endanger other users
- Send repeated or abusive join requests to circumvent a host's decision to decline you
4. User Content
You retain ownership of content you upload (e.g. profile pictures, session descriptions). By uploading content, you grant Join in a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of operating the Service. You are responsible for ensuring you have the rights to any content you upload.
5. Sessions
Sessions are user-created listings for coordinating sports activities. The creator sets a visibility tier: public, friends of friends, friends only, or invite only. Depending on the tier, other users can either join directly or send a request to join, which the creator can accept or decline.
Join in does not organize, supervise, or assume responsibility for any real-world activity coordinated through the Service. You choose who you meet and which sessions you join or host; we do not vet users, venues, or the suitability of any activity.
You participate in any sports activity, and any meetup arranged through a session, entirely at your own risk. Join in is not liable for injuries, accidents, disputes, or damages arising from activities coordinated through the Service, to the extent permitted under Section 11.
Attendance and session details shown in the Service are user-reported and may not be accurate or current.
6. Location Data
Certain features, including browsing nearby sessions on the map, require access to your device's foreground location. You can revoke location access at any time via your device settings, though this will disable location-dependent features.
7. Push Notifications
With your permission, we send push notifications about friend activity, session invitations, and join requests. You can disable notifications at any time in your device settings or the app's notification preferences.
8. Intellectual Property
The Join in name, logo, design, and all associated content are the property of Join in. You may not use our trademarks, logos, or branding without written permission.
9. Termination
- You may delete your account at any time. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
- We may suspend or terminate your account if you violate these Terms, with or without prior notice.
- We may discontinue the Service at any time with reasonable notice.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. Real-time data (session details, occupancy) is user-reported and may not be accurate.
11. Limitation of Liability
To the maximum extent permitted by law, Join in shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. This includes, but is not limited to, injuries during sports activities, disputes between users, loss of data, or service interruptions. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim (if any).
Nothing in these Terms limits liability for intent or gross negligence, or for claims under mandatory statutory provisions.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction is Berlin, Germany, unless mandatory consumer protection laws provide otherwise.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
